These Terms of Service ("Terms") govern your access to and use of AquaBoard (the "Service"), operated by AquaBoard Training ("AquaBoard," "we," "us" or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Service description
AquaBoard provides written swim workout content for informational and training purposes. Workouts are published on a recurring schedule and organized into multi-week training blocks at several difficulty levels. The Service does not provide in-person coaching, supervision or individualized medical or athletic advice.
2. User accounts
You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us promptly at the address below if you believe your account has been accessed without your authorization.
3. Subscription and billing
- Access to the Service requires a subscription of $20 per month.
- Payments are processed by Stripe. Your subscription renews automatically each month until cancelled.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period, and you retain access until that date.
- We do not issue refunds or credits for partial months of service.
4. Intellectual property
All workout content, training plans, text, graphics and other materials made available through the Service are owned by AquaBoard and are protected by copyright and other intellectual property laws. Your subscription grants you a limited, personal, non-transferable license to view and use the content for your own training. You may not copy, redistribute, publish, sell, resell or otherwise commercially exploit any content from the Service without our prior written permission.
5. Disclaimer of liability
The Service and all workouts are provided "as is" and "as available," without warranties of any kind, express or implied. You should consult a physician before beginning this or any exercise program, particularly if you have any medical condition, injury or concern about your health. Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath or discomfort.
To the fullest extent permitted by law, AquaBoard is not responsible for any injury, illness, loss or damage sustained while following, or as a result of following, any workout provided through the Service.
6. Assumption of risk
Swimming and aquatic exercise involve inherent risks, including but not limited to drowning, injury, overexertion and cardiac events. You are solely responsible for determining whether a workout is appropriate for your ability and condition, and for swimming in a safe environment, including where appropriate under the supervision of a lifeguard. By using the Service, you knowingly and voluntarily assume all such risks.
7. No guarantee of results
Training outcomes depend on many factors outside our control, including consistency, health, nutrition, recovery and individual physiology. We make no guarantee that you will achieve any particular level of fitness, time improvement or competitive result.
8. Modification of terms
We may update these Terms at any time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
9. Termination
We reserve the right to suspend or terminate any account that violates these Terms, including by redistributing workout content, without prior notice. You may close your account at any time from your account settings or by contacting us.
10. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.
